Welcome to Fairway Femmes. These Terms of Service ("Terms") are a legal agreement between you and Fairway Femmes ("we," "us," or "our") that governs your use of our mobile application and related services (the "Service").
By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Who Can Use Fairway Femmes
You must be at least 18 years old and able to form a legally binding contract to use the Service. Fairway Femmes is designed as a community for women golfers and those who identify as women. By creating an account, you represent that you meet these requirements.
You are responsible for all activity that occurs under your account. Keep your login credentials secure, and let us know immediately if you suspect unauthorized access.
2. Your Account
You agree to provide accurate information when you create your account and to keep it up to date. You may only maintain one account, and you may not share your account with anyone else.
We may refuse, suspend, or terminate accounts at our discretion, including for violations of these Terms or conduct that we believe harms other users or the Service.
3. Subscriptions & Payment
Fairway Femmes offers Free, Basic, and Premium subscription tiers. Paid subscriptions are billed through the Apple App Store or Google Play Store, depending on the device you're using.
Auto-Renewal
Paid subscriptions automatically renew at the end of each billing period unless you cancel beforehand. You can cancel any time through your Apple or Google account settings. Cancellation takes effect at the end of the current billing period — you'll keep access until then.
Refunds
Refunds are handled by Apple or Google according to their respective policies. We generally don't issue refunds directly, but you can request one through the store where you purchased your subscription.
Price Changes
We may change subscription prices. If we do, we'll notify you in advance, and price changes won't take effect until your next billing cycle. If you don't agree to a price change, you can cancel before it takes effect.
4. Acceptable Use
Fairway Femmes is a community space. To keep it that way, you agree not to:
- Harass, bully, threaten, or intimidate other users
- Post or share content that is illegal, hateful, sexually explicit, or violent
- Impersonate anyone else or misrepresent your identity
- Send spam, promotional messages, or unsolicited commercial content
- Attempt to access accounts or data that aren't yours
- Use the Service to solicit, exploit, or endanger others
- Interfere with or disrupt the Service, including attempts to reverse engineer, scrape, or automate access
- Violate any applicable laws or the rights of others
We take violations seriously. We may remove content, restrict features, or terminate accounts that violate these rules.
5. Playing Partner Safety
Important: Fairway Femmes helps you find people to play golf with, but we don't verify the identity of users or conduct background checks. When meeting someone in person for the first time, use good judgment: meet in a public place like a golf course, share your plans with a friend, and trust your instincts.
You are responsible for your own safety when interacting with other users and when meeting in person. Fairway Femmes is not responsible for the conduct of any user, whether online or offline.
6. Your Content
You keep ownership of the content you submit to the Service — your messages, posts, photos, round logs, and anything else you create. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content as needed to operate the Service.
You represent that you have the right to submit any content you post, and that it doesn't violate anyone else's rights.
We may remove content that violates these Terms or that we reasonably believe harms the community.
7. Handicap & Round Data
Fairway Femmes tracks handicaps and round scores for your personal use within our community. Our handicap calculations are not a substitute for an official World Handicap System (WHS) index issued by an authorized handicap authority, and should not be used for official competition purposes. Use of our handicap feature is informational only.
8. Our Content & Intellectual Property
The Fairway Femmes app, website, logos, design, and all related content (other than content you submit) are owned by Fairway Femmes and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our written permission.
9. Third-Party Services
The Service integrates with third-party services, including Apple, Google, Supabase, RevenueCat, and others. Your use of those services is governed by their own terms. We're not responsible for the practices or content of third-party services.
Course data in our app is provided by GolfAPI.io. We do our best to keep it accurate but can't guarantee it's complete or up-to-date.
10. Termination
You can stop using the Service and delete your account at any time from within the app or by contacting us. See our account deletion page for details.
We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service. If we terminate your account for a reason unrelated to your conduct, we'll refund any prepaid subscription fees for the unused portion of your subscription.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee that the Service will be uninterrupted, error-free, or completely secure.
Fairway Femmes is a social and community tool. We don't endorse any user, content, or interaction, and we're not responsible for how users act on or off the Service.
12. Limitation of Liability
To the fullest extent permitted by law, Fairway Femmes and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) one hundred dollars ($100).
Some jurisdictions don't allow the exclusion of certain warranties or limitation of liability, so some of these limitations may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Fairway Femmes from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or the rights of others.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any disputes will be resolved in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@fairwayfemmes.app.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we'll notify you through the app or by email and update the "Last updated" date. Continued use of the Service after changes take effect means you accept the updated Terms.
16. General
These Terms are the entire agreement between you and Fairway Femmes regarding the Service. If any part of these Terms is found to be unenforceable, the rest remains in effect. Our failure to enforce a provision doesn't waive our right to do so later. You can't assign these Terms without our consent; we can assign them.
